NYSDMV Official Information About Driver Responsibility

A change to the NYS Vehicle and Traffic Law requires drivers who are convicted of specific traffic violations to pay an assessment to the DMV.

Referred to as The Driver Responsibility Program, it applies to all drivers who operate, or operated, a motor vehicle in the State of New York, regardless of the state the motorist is licensed in. The purpose of this program is to prevent the repeated behavior of problem drivers and to improve traffic safety.
 
In addition to any fines, fees, penalties or surcharges that you pay for a traffic conviction, you must pay the driver responsibility assessment.  It is a specific amount that you must pay each year for three years to the DMV.

You are required to pay the driver responsibility assessment if any of the following incidents occur:
  • You are convicted of an alcohol-related traffic violation occurred in NYS on or after November 18, 2004, including boats and snowmobiles 
  • You are convicted of a drug-related traffic violation and the violation occurred in NYS on or after November 18, 2004, including boats and snowmobiles 
  • A DMV hearing determines that you refused a chemical test and the refusal occurred in NYS on or after November 18, 2004, including boats and snowmobiles 
  • You receive six or more points on your NYS driver record during a period of 18 months and the violations occurred in NYS, Quebec or Ontario on or after November 18, 2004

Let’s look at this, case by case.

Case number five: original charges were speeding, no seat belt and no insurance adding up to $510 in fines and 4 points. Traffic Ticket Nassau County reduced each of these charges to total 2 points and only $185 fine, saving the client $195 and 2 points.

Case number six: original charges were aggressive driving, a misdemeanor offense, improper turning and tailgating. These charges should’ve cost the drive 6 points on his license and $1,055 in fines. Red-Light Tickets - Answers From the VP

Red-light cameras have been a popular topic on the Traffic Ticket Nassau County Blog. A recent article published by the Poughkeepsie Journal provides answers from American Traffic Solutions, the Arizona firm that manufactures the red-light cameras to many frequently asked questions and concerns.

The red-light camera system was first installed in NYC in 1993 to monitor problematic intersections that experience a high rate of drivers running red lights. Today, the general public is concerned, feeling that theses summons cannot be contested and that some tickets are issued falsely.

Here’s what the manufacturers Vice President of Communications Charles Territo had to say to thePoughkeepsie Journal.

“We do the initial screening to identify whether or not a violation took place and whether it is able to be prosecuted… There are times that we take a picture of the rear of a car and also take a video of the vehicle. If the criteria identifying a violation are met, a picture is taken. However, if the vehicle suddenly stops and doesn’t create the violation, then that is dismissed… In fact, there’s a great deal of redundancy in the review process to ensure that only violations are issued."

Garden City: Victim of 14 Crimes in 8 Days!

Garden City was the victim of multiple crimes earlier this month.
An article published by Garden City Patch reported 14 crimes between August 31st and September 7th which occurred on the streets of Garden City.
Amongst the reported offenses were multiple car break-ins, with the removal of personal items including a wallet, EZ Pass, cell phone and a briefcase, as well as a break-in to a Meadow Street resident’s garage and the Garden City Pool. In all cases, something was stolen.
An officer was assigned to a traffic detail on Cherry Valley Avenue for a traffic light malfunction. Were you issued a false ticket there?

New Addition to Red Light and Speed Cameras: Your Name Published in the Newspaper!

If you haven’t already heard, red light tickets are becoming more and more popular in the recent year or so. This is not a result of more police officers on the street; it’s a direct result of red-light cameras positioned at intersections known as RoboCops.
Mayor Bloomberg thinks we need to take this age of technology a step further and have red-light cameras on every corner. In addition, he wants to put up speed cameras to catch those speeding on every corner as well. Currently the city can put up cameras wherever they want, but can only issue tickets to those they have permission for.
So, what does Mayor Bloomberg plan to do with the people he catches but does not have permission to ticket? Publish their names in newspapers!
According to an article posted by gothamist, Mayor Bloomberg is concerned for the elderly and kids, who are usually the victims of hit and run incidents. This thought presumably is the reasoning behind publishing the names of those who are caught in newspapers, proving to Albany how necessary all the cameras are.

Hurricane Irene Issues Traffic Tickets!

This past weekend many areas were still left with no power after Hurricane Irene blew through Long Island August 27th-28th. Many traffic signals are still not working, 26 across the island- 13 in Nassau County and 13 in Suffolk County, to be exact.
Nassau and Suffolk County police urged motorists all weekend to use caution at intersections where lights were still “out of order.” At some intersections, lights were not working at all and in others, off working off cycle creating danger zones for those driving.
Technicians were on call, according to Eileen Peters, spokeswoman for the Department of Transportation. “As soon as the power comes on, they [technicians] are out to check that they [traffic signals] are cycling correctly,” she said to a News Day reporter.
