You Can Plead NOT GUILTY to a Traffic Violation! Here's How...

You can plead NOT GUILTY to a traffic violation issued to you by a Nassau County Police Officer. How? Let Traffic Ticket Nassau County explain and help! 

There are a few ways you can plead NOT GUILTY:

Follow the instructions on the back of the ticket, filling out the right side of the back of the ticket; sign it, and mail it to the Court within forty-eight hours of receiving the violation. Be sure to include your current mailing address. You can also plead not guilty by appearing in person in Court on the court date specified on your ticket.

You can request a Supporting Deposition by checking the appropriate box on the back of ticket. A Supporting Deposition will provide you with additional information regarding the basis for the ticket.   A Supporting Deposition request must be timely; that is, a defendant must have already been arraigned and have made a request for the supporting deposition before the end of thirty days following the return date appearing on the ticket.  

If timely requested, the Court will order the Supporting Deposition from the police officer who issued the ticket. The police officer will have 30 days from the date of your request to mail you the Supporting Deposition. Your case will then be scheduled for a non-jury trial; you will receive written confirmation of the trial date from the Court.

Nassau County Traffic Tickets Issued Decrease in 2011! Why?

Newsday recently reported that in Nassau County, from January through August 2011, there were only 110,000 traffic tickets issued by police officers. If you do the math, that’s fewer than six summonses per police officer per month (accounting 2,390 Nassau officers). 

 “Fewer summonses no doubt pleases most drivers. Even considering that as many as half of Nassau police are not in uniform, the total number of summonses issued is still beyond comprehension. If an officer is on patrol 20 days in a month, six summonses a month is woefully inadequate,” reports the recent Newsday article
 
Unfortunately, Long Islanders were outraged by the lack of tickets issued. “Nobody likes getting a summons, but they serve an important purpose,” notes the Newsday article. “A moving violation corrects a problem driver. It prevents accidents and saves lives.”

Although people have complained about the red-light camera tickets, some believe it has made Nassau County a safer place to commute around. “They are brutally effective. On Long Island before the cameras, driver went through intersections two or three seconds after lights turned red. That no longer occurs. Long Island drivers are much less aggressive at all intersections as a result of a relatively small number of cameras,” (Newsday).

Acting Police Commissioner Thomas Krumpter mentioned a few theories as possible reasons for the decline in summons issued to Newsday: last winter’s severe weather, the effectiveness of red-light cameras, more drivers following the speed limit or the retirement of some high-output ticket writers.

Red-Light Cameras Are At It Again- This Time For Making Right Turns on Red!

It look’s like red-light cameras are at it again! This time, it’s not just for those running a red light. 

Frank Saladino received a $100 red-light ticket for failing to come to a complete stop before making a right-on-red turn at an intersection where right-on-red turns are allowed.  

Frank Saladino stands by the intersection of UnionTurns out, your car has to come to a complete stop, at 0mph (or for 3 seconds as Saladino found out from officials) before you can proceed to turn on red where permitted.

Christopher Mistron said “state law doesn’t contain any reference to 3 seconds – or any other length of time. Rather, a complete stop means cessation of movement and that’s what the people who review the red-light camera recordings are looking for,” (Newsday). 

Mistron also said that licensed drivers should know that a complete stop is necessary, citing a section of the state’s Vehicle and Traffic Law that says drivers “may cautiously enter the intersection to make a right turn after stopping,” (Newsday). 

Moral of the story, those red-light cameras will issue you a ticket if you don’t come to a complete, full stop, before turning, so make sure you stop if you don’t want a ticket.
