NYS Vehicle and Traffic Law Requires an Assessment Fee

A change to the NYS Vehicle and Traffic Law requires drivers who are convicted of specific traffic violations to pay an assessment to the DMV.

Referred to as The Driver Responsibility Program, it applies to all drivers who operate, or operated, a motor vehicle in the State of New York, regardless of the state the motorist is licensed in. The purpose of this program is to prevent the repeated behavior of problem drivers and to improve traffic safety.
 
In addition to any fines, fees, penalties or surcharges that you pay for a traffic conviction, you must pay the driver responsibility assessment.  It is a specific amount that you must pay each year for three years to the DMV.

You are required to pay the driver responsibility assessment if any of the following incidents occur:
  • You are convicted of an alcohol-related traffic violation occurred in NYS on or after November 18, 2004, including boats and snowmobiles 
  • You are convicted of a drug-related traffic violation and the violation occurred in NYS on or after November 18, 2004, including boats and snowmobiles 
  • A DMV hearing determines that you refused a chemical test and the refusal occurred in NYS on or after November 18, 2004, including boats and snowmobiles 
  • You receive six or more points on your NYS driver record during a period of 18 months and the violations occurred in NYS, Quebec or Ontario on or after November 18, 2004

  1. If you want to beat a traffic ticket is very very important not to plead guilty because if you do the chance to dismiss the ticket are closed to 0.
    My lawyer told me this wen I went to hire him to avoid a careless driving Toronto charge and he told me that I did a big mistake by pleading guilty.....It was a lesson I learned quickly and now every single time I get a ticket I plead innocent just to have a chance to dismiss it in court:P
