MADD Annual Law Enforcement Luncheon A Success

(516) 319-5822

Every year, the Long Island chapter of Mothers Against Drunken Driving (MADD) holds a luncheon to honor Long Island law enforcement, which includes officers, attorney and local citizens who display a high-spirited amount of commitment against drunk driving.

The special guest speaker was Michael Tangley, commissioner of the Long Beach Police Department. He spoke of his determination with law enforcement and his commitment to eliminate drunk driving. He is the great-uncle of Katie Flynn, then 7, who died in a head-on car crash on the Meadowbrook Parkway in 2005. The driver’s alcohol level was .28, more than three times the legal limit.

The driver of the vehicle in the crash, Martin Heidgen, was sentenced in February 2007 to 18 years to life in jail. He and his lawyer filed to have the ruling appealed in January 2011, but that appeal was overruled.

More than 72 law enforcement professionals were honored at the event and was hosted gratis by Chateau Le Mer in Lindenhurst. Many local businesses in support of MADD’s mission were also in attendance, which included State Farm, TD Bank, Suffolk County Benevolent Association and BBA Photography.

Long Island Wildfires...

(516) 319-5822

Investigators are still looking into how the wildfire started in the Pine Barrens of Suffolk County, and Governor Andrew Cuomo declared a state of emergency in Suffolk County on Long Island.

The fire burned up 1,124 acres of land and it has been largely contained, although the winds have picked up and could cause some additional flare-ups.

“All the ingredients were there for a real tragedy,” Cuomo said right after touring the scene from a helicopter over Manorville and Ridge. “This is a situation that could have gotten out of control. If you lost control of a fire this large, it could have been very, very, very bad.”
Cuomo also praised the efforts of the response teams, including the volunteer firefighters. Although there were no casualties, the seventh largest fire in state history burned down three homes and left three firefighters injured.

Jerome Hauer, state commissioner of homeland security and emergency services, warned that conditions for additional fires will remain optimal for at least another 10 days (recordonline.com).

“People are going to need to be very careful with outside burning of any kind,” said Hauer. “Anything they do outdoors, whether cigarettes or barbecues has the potential of lighting the underbrush.”

Of the three injured firefighters, two were released from Stony Brook University Medical Center after being treated for smoke inhalation, and one was admitted with first and second-degree burns.

NYS Vehicle and Traffic Law Requires an Assessment Fee

(516) 319-5822

A change to the NYS Vehicle and Traffic Law requires drivers who are convicted of specific traffic violations to pay an assessment to the DMV.

Referred to as The Driver Responsibility Program, it applies to all drivers who operate, or operated, a motor vehicle in the State of New York, regardless of the state the motorist is licensed in. The purpose of this program is to prevent the repeated behavior of problem drivers and to improve traffic safety.

In addition to any fines, fees, penalties or surcharges that you pay for a traffic conviction, you must pay the driver responsibility assessment.  It is a specific amount that you must pay each year for three years to the DMV.

You are required to pay the driver responsibility assessment if any of the following incidents occur:
  • You are convicted of an alcohol-related traffic violation occurred in NYS on or after November 18, 2004, including boats and snowmobiles
  • You are convicted of a drug-related traffic violation and the violation occurred in NYS on or after November 18, 2004, including boats and snowmobiles
  • A DMV hearing determines that you refused a chemical test and the refusal occurred in NYS on or after November 18, 2004, including boats and snowmobiles
  • You receive six or more points on your NYS driver record during a period of 18 months and the violations occurred in NYS, Quebec or Ontario on or after November 18, 2004

As of March 26, 2012, Nassau County Executive Edward P. Mangano announced that the Nassau County Boot and Tow Program has become official. It has been set up to help collect unpaid fines from scofflaws with parking or traffic violations.

All vehicle owners who have three or more unresolved parking violations or unresolved Red Light Camera Notices of Liability, are considered scofflaws, and they will be subject to the Boot and Tow Program (antonnews.com).

Owners and vehicles that have not paid their outstanding tickets will have their vehicles immobilized and could possibly be removed from the scene. The owner will be liable for these expenses, and the vehicle will not be released until all fines, surcharges and additional fees are paid in full.

“We’ve provided more than enough time for scofflaws to come forward and pay their fines, but time is now running out for them,” Mangano said. “Nassau County is owed millions of dollars in these fines and we’re going to use all available methods to collect. If you have three or more outstanding tickets, I urge you to pay up or see your vehicle get booted and possibly towed.”

This program will be administered by PayLock and will use SmartBoot technology, which provides a number of advantages over traditional booting and impounding.

Motorists will be able to settle outstanding citations through a help center that is staffed 24 hours a day, seven days a week and to remove the boots themselves, by calling and obtaining the method to be used to remove the boot rather than relying on waiting for someone to comes and remove the boot (antonnews.com).

Studies show that you are 23 times more likely to be involved in an accident when texting and driving.

Although many refuse to take the situation seriously, texting while driving is extremely dangerous.
48% of young Americans from ages 12-17 say they’ve been in a car while the driver was texting and 34% admit to text messaging while driving. What teens (and adults) fail to realize is that texting while driving is about 3 times more likely to result in an accident than driving while intoxicated.

New York’s law against texting while driving went into effect on November 1, 2009, forbidding the use of mobile devices for reading, typing and sending text messages while driving. The ban on texting while driving comes with fines up to $150.

Stop texting while driving! Watch AT&T’s new 10-minute documentary titled “The Last Text,” featuring stories of real individuals whose lives have been adversely affected by texting behind the wheel.

AT&T created this documentary as part of its “It Can Wait” campaign because they want consumers to be safe while using their technology. Take a few minutes to watch the documentary in its’ entirety. Share it with your family and friends, especially those known to text while behind the wheel.

Should you find yourself with a texting-while-driving ticket, do NOT plead guilty. Call Traffic Ticket Nassau County at 516-319-5822 immediately for your FREE consultation. For more information, visit TrafficTicketNassauCounty.com.
