If a police officer suspects you have been drinking, he WILL pull you over! With the STOP-DWI Law, both enforcement and prosecution of drunk driving is greater than ever before. State and local police are doing blanket patrols and checkpoints to aid in the apprehension of drunk drivers. 

These enforcement efforts can occur at any place and at any time, but are predicted to be at record highs over the holiday season. 

Leandra’s Law was signed into law in November of 2009 in honor of Leandra Rosado, an 11-year old killed while a passenger in a vehicle with the intoxicated mother of one of her friends. In response to the tragedy, NYS Legislature made several changes to the Vehicle and Traffic Law.

 The law strengthened penalties against motorist who drink and drive, and require that a person sentenced for DWI have an ignition interlock device installed on any vehicle they own or operate and the driver have an “ignition interlock” restriction added to their driver license - in addition to any fine, jail or prison sentence.

If a police officer believes you are intoxicated while behind the wheel, you will be arrested and requested to take a BAC test. If convicted, you will face a substantial fine, license revocation, higher insurance costs, legal fees and a possible jail sentence.
